Appeal Success in the Green Belt

Working on behalf of Beaumont Residential, Boyer secured planning permission, at appeal, for the redevelopment of a business park to provide 10 new homes within the Green Belt.

Boyer was instructed at the appeal stage after the proposals had been refused by Reigate and Banstead Borough Council as officers considered that the new buildings would have an adverse impact on the openness of the Green Belt whilst the site was also not considered to be a sustainable location for new residential development.

The Inspector agreed with our case concluding that the development would preserve the openness of the Green Belt despite changes in building height and scale across the site.  The Inspector also agreed that the benefits of development (e.g. the provision of new housing, reduction in flood risk as a result of the proposed SuDs and removal of HGV movements) would outweigh the relative isolation of the site and so thereby it would constitute an appropriate location for new residential development.  The Inspector reached these conclusions having regard to guidance contained within the revised NPPF.
