Garden Centre in the Green Belt
Boyer are delighted to have secured a resolution to grant planning permission for a 3,000 sqm Garden Centre in the Green Belt in Berkshire, after the Committee overturned an Officer’s recommendation for refusal.
It is particularly welcomed as the site has a complex planning history with the Owner having been subject to an Enforcement Notice prosecution as well as Injunctive proceedings, after which the Council were found guilty of an Abuse of Process for enticing the applicant to withdraw their Enforcement Appeal and then refusing a certificate of lawfulness – but this came too late to help the Owner. The planning system simply did not work in these circumstances. Over the last five years we have been working to find a long term sustainable solution for the Client, cumulating in the resolution to grant.
