Berkley House Appeal Success

Boyer submitted the planning appeal and acted as planning witness over a seven-day inquiry on behalf of Berkeley Homes to secure the demolition of the existing offices at Berkeley House and the construction of a new flatted development for 69 residential units. The main issues raised on the appeal related to the effect on the character and appearance of the area, including the effect on trees, the impact on designated open space, and the effect of the proposed development on the setting of the nearby Conservation Areas.

During the appeal Sevenoaks District Council attempted to expand the scope of the issues beyond the original grounds for refusal. In a significant development, the Planning Inspector deemed the Council’s actions unreasonable and awarded a portion of the costs incurred by Berkeley Homes on the appeal.
